5.1. The Company and/or the parties involved in transactions/payments have the right to request checks and documents (KYC/AML/sanctions/anti-fraud).
5.2. Until the checks are completed, the Company has the right to suspend access, statuses, attribution, charges, and withdrawals.
5.3. Fraud/circumvention/forgery/manipulation = blocking and cancellation of charges.
5.4. Initial KYC (access to features)
5.4.1. Part of the Platform's partner features (including, but not limited to: activation/use of referral tools, advanced sections/statuses/analytics, limits, and actions) is opened only after passing Initial KYC and providing the requested documents.
5.4.2. Initial KYC is needed to:
(a) protect the Platform from fake accounts, bots, multi-accounts, forgery, and manipulation;
(b) to comply with compliance requirements and requirements of business partners;
(c) to ensure uniform access rules without “manual” solutions.
5.4.3. Initial KYC may include: phone verification, identity document (passport/Emirates ID or equivalent), selfie/live check, and other data required for anti-fraud.
5.4.4. Prior to Initial KYC, the Company may restrict functionality, limits, or refuse participation.
5.5. Pro KYC + AML before payment (mandatory)
5.5.1. Before any payment/withdrawal/receiving of remuneration, the Partner is required to pass Pro KYC + AML (including sanctions and anti-fraud control), if required by the terms of the project, the payer, banks/payment providers and/or compliance.
5.5.2. Pro KYC/AML may include: extended identification, confirmation of the details of the recipient, checks of sanctions/PEP/restrictions, additional checks at increased risk.
5.5.3. Why Pro KYC/AML: legality and security of payments; prevention of financial crimes; protection of the Platform/Partners/partners from blocking, fines and cancellation of payments.
5.5.4. Failed to pass the checks / refused / provided false information → payment is not made, accruals may be suspended or cancelled.
5.5.5. Checks may be carried out by the Company and/or authorized providers/contractors.
5.6. Sanctions Lists and Restricted Jurisdictions (Passport Ban)
5.6.1. The Company does not cooperate with or accept Clients and/or Partners if they:
(a) are subject to sanctions (matching/confirmation on sanctions lists); and/or
(b) use a passport/document issued by Restricted Jurisdictions.
5.6.2. As of the effective date of the Regulations, the Restricted Jurisdictions under the “countermeasures” criterion include:
— Democratic People’s Republic of Korea (DPRK / North Korea)
— Iran (Iran)
— Myanmar (Myanmar)
5.6.3. These restrictions apply to both client accounts and partner accounts (passports from these jurisdictions are not accepted).
5.6.4. If the automatic system mistakenly misses a registration/account with such a passport, then upon subsequent verification (including Pro KYC/AML before payment) the Company shall have the right to:
(a) immediately restrict/suspend the account;
(b) refuse payment and/or cancel charges;
(c) block the account(s) without compensation, if required by compliance/law/requirements of banks/partners;
(d) to transfer information to the parties involved and/or competent authorities, within the limits of the law and the Privacy Policy.
5.6.5. The list of Restricted Jurisdictions may be expanded/modified for compliance purposes. The priority is the current version on the Platform.
